Dear Friends,

I've one doubt in my mind.

1. Is contract workmen eligible for Bonus ? if Eligible under what Section / rule / Judgement.

Sec 8 of the Payment of Bonus Act, 1965 states that every employee is entitled for bonus if he has worked in the establishment for not less than 30 days in that year, ( ACCOUNTING YEAR)

Contract labour also fallls under the definiton of employee. therfore he is eligible for bonus.

Dear Ayesha,

Yes. Contract labour is eligible to get bonus from his employer i.e contractor. During the negotiation, the amount build up should contain the element for bonus
also.

However, I would advise you to refer "Payment of Bonus Act" to clear your doubts..

All employees, including contract employees, drawing less than or equal to Rs 3500/- are eligible for Bonus if they complete working 30 days including weekly offs, paid leave or paid holidays.

For details pl check payment of Bonus Act.
