Hi,
I have a query about terminating an employee on grounds of falsification of data. What happens when an employer realizes that an employee has falsified information supplied during the time of making an offer? The employee signs a declaration that he/she is aware that falsification is sufficient grounds for termination. But I am trying to understand the legal angle to this issue.
Thanks, bijoy |

I recently came across this case, maybe u would like to do some indepth study, to understand the legal aspect….
False Declaration by Employees
Kendriya Vidyalaya Snagathan & ors. v. Ram Ratan Yadav, 2003 LLR 433 (SC)
Suppression of material facts or giving false declaration in employment applications will lead to termination of service.
Inference:
1.Declarations made by applicant in employment forms are very material.
2.2.On found guilty of suppression or false declaration, it is no defence to state that he did not understand the language or the implication of the statements required thereunder
