Dear Friends,
I need your suggestion on do's to handle a termination case. The facts are as follows:
1. The staff is a German National working with us in the capacity as Consultant. 2. The contract has been entered wherein the termination clause mentions 3 months notice or sal in lieu of notice. 3. It also refers termination with out any notice in the event found quilty of a criminal offence or for any serious reason of discipline (misconduct).
We have couple of facts documented such as insubordination, unruly behaviour with staff and management, etc.
Very recently she has gone on for leave without any approval of concerned person and leaving the work unattended and so forth. We want to terminate her with the above facts.
I would request from my learned friends what things to be kept in mind as being a german citizen. (She is married to an Indian now and been with us since July 05)
This is quite urgent and will highly appreciate from my learned friends the legal side of it as well the do's and dont's.
