Legal Action against Absconding Employee

Dear All,

I have a situation like, one person joins one organization and works for a day and he doesn't report back to the Organization. He absconds. Can we take any legal
action against him.

I heard from somebody that the employee has to work for a minimum of 15 days in an organization to take legal actions. Is that true...

Jac,

A lot of people do such things all the time. But I dont think there is anything much you can do. Legally it is not possible to punish unless the person is absconding with some material from your premises.

I am sure you are aware that for any person who joins an organisation, there is a set of joining formalities to be completed. These include instructions on termination of services by either side.

Please check that clause to see if there is anything that is specified about taking legal action against an employee and whether that person has signed it off as accepted.
