Hi,
We have temp employees working with us. We take them for three months but keep extending them, and thus we have employees with us for more than 2 to 3 years working with us. From the legal point of view can these employees claim to be our employees? and what else can they claim for?
Or is it a better idea to put these employees on to a service provider? can they still claim anything from the principal employer? I need a legal view of this and if anyone can give me the section number etc or at least where can i get this information?

Hi,
Even in my organization, we are having few temporary electronic and software engineers, whom we keep on extending on their respective contracts, we deduct their TDS, and PF & Welfare contribution are not deducted, in case of legality, i do not think any legal implications should be their.
What i know about the same is in case of other services like temporary mechanics, electricians, housekeeping staff etc, we can have contract with main agency/company and keep on renewing it, if we want long term of services.
Rather, i would also like to get enlighten on the same with Nirmala by other members of this forum.
