Dear All,
One of my friend is employed in a private Ltd. IT company which has a provision for paid leave but the employer says this can be encashed only on leaving the job (without interest) and that too only 25% of the amount will be payable if the employee leaves the job within or after a year. Please guide on as to how she can get complete reimbursement for the same. She has completed 10 months in the job. Is there any legal provision that empowers the employer to pay only a part of paid leave?

Dear Palak,

Leaves are encashed as per the company policy & when the management decides to encash. This is generally done post finalization of the balance sheet. In case of the resigned employee balance leaves are encashed at the time of full & final settlement only. There could be different ways of encashement of leaves for resigned employee / active employee.

Pls. ask your friend to take clarification form her HR Dept wrt such policy. If the policy is in existence then the calculations would be done as per prevailing policy. However management has all right to decide as an exceptional case.

Its depend upon the company policy, Leaves counting calender year Jan to Dec, every completed one year encashe the EL's this is also company policy.
