Hi all,

I am currently working as an hr executive in an NGO. Does anyone knw the labour laws applicable to NGOs in India???

I would like to share the following information. As far as my knowledge the following laws are applicable to Section 25 company (NFPO).

Applicability of all related labour laws to a Sec 25 company (NFPO)

 

The following labour laws are applicable to Section 25 Company.

 

a)                  Workmen Compensation Act

b)                  Minimum Wages Act

c)                  Payment of Wages Act

d)                  Payment of Bonus Act

e)                  Contract Labour Act

f)                    Child Labour Act

g)                  National & Festival Holidays Act

h)                  Apprentices Act

i)                    Indian Penal Code

 

Although the above laws are applicable to the section 25 companies, for the purpose of trainee employees other acts excepting Apprentices Act are not applicable, if they are appointed as per Apprentices Act, 1961.

The provisions of this Act shall not apply to any area or to any industry in any area unless the Central Government by notification in the Official Gazette specifies that area or industry as an area or industry to which the said provisions shall apply with effect from such date as may be mentioned in the notification.

However, please do consult your local labour consultant to ascertain the above points.
