Sir / Madam,

In my organization, many people are coming late and even arguing that late coming is allowed 3 times in a month. Though we have an standing order saying that habitual late commers will be punished, we haven't specified no of days since regular comers also will have the feel that late coming is acceptable.

However, I saw the definition of 'habitual' in the Factories act and it clearly says 'the activity if repeated 3 or more times in a span of 12 months'. Based on this shall I change the standing order as 'acceptable late coming is one in a quarter'?

Will it have any impact / comment from statutory bodies? Please help.

Recently an employee claims that late coming is allowed as per law! Is it true?

Dear Shriramji,

Late coming is not Official allowed by the law.

Habitual late coming is stated in the Model Standing Orders.

It depends on the Company to Company, regarding the policy of late coming.

As far as our Company is concerned, we have 15 minutes late coming allowed, within 3 occasions, after that their salary is deducted.

The late coming varies from organisation to organisation and it has to be specifically mentioned in the standing order and it has to be known to the employee. You can initiate action subject to the conditions spelt out in standing order Gopu

Hello Shriram,

Why don't your organisation implement flexi time facility.  for eg.

If any employee comes 15 min. late no need to compensate time.  But, employee comes after 15 min. up to 30 min. needs to compensate late coming timing by seating after closing office hours.  Those who comes after 30 min. of start hours has to take half a day leave.  This policy will make employees disciplined for arrival and leaving office hours. 

You could also allow them 2 years concession period 4-5 times in a year to meet their personal work requirement.
