Do R&D facilities need factories licence to operate?

Dear Sir,

Factories act doesn't differentiate a commercial production or trial production activity. It clearly says any organization involves 10 or more people with power [or] 10 or more people without power involving in an manufacturing activity [R&D work also shall be an manufacturing activity, where power-aided equipments and solvents may be used]. I feel it is required in case of power-aided, hazardous chemicals handling unit. In case of software related R&D it may be under Shops & Commercial establishment.

If the R & D function is already a part of the existing factory there is no need to cover them under factory provided you have the function in the original licence. However in the R & D if you carry out activities which comes under the definition of Factory Act it has to be covered under Factory. Gopu

If location is different of your existing factory and R & D facility then also you have to get  separate licenses for both.
