This is to submit that nature of business is also a consideration in the said act, that is to say, if a company is engaged in marketing activities, all business transactions requires permanent employees to be employed and to such organizations House Keeping need not to be in permanent roles has this has no direct contact with the business the company is undertaking. However, if there is a company which gives housekeeping services that company cannot hire contract labour for their regular activities of house keeping. Apart from such companies all companies which does house keeping as a part of daily routine is to ensure the clean atmosphere which has direct link with more output rather than direct output.
Concept is confusing to grasp however that is the truth. Companies can indeed hire contract labour for housekeeping activities save with few exceptions and that exceptions depends on circumstances the company is based upon.
For Eg. Let me take an example of hazardous chemical mfg company. Such companies are expected to regulate the quantum of exposure upon their employees who are in direct contact with such chemicals. Those staff who are directly involved in such process cannot be contract labour however, employees who are involved in office cleaning like desk and white boards (Punes to be exact) can be contract labour.
Here too, there are some exceptions. For eg hospital wastages disposal requires expert manpower and such areas can be outsourced as a process however contract labour is out of sight.
