Employee did not turn up after two days of joining

One of our employee did not turn up to work after two days of joining. He told us that he had some family issues and will not be able to come to office. We considered it as LOP and credited his account with 2 days salary and joining bonus.  Now he says he will not be joining back and informed us that he would return the 2 days salary and the joining bonus.  Is it legal to ask him to pay us 2 months salary for not servicing the notice period which we follow for other employees. But as this person has worked only for 2 days is it legally accepted to collect 2 months salary from him or please suggest what action can we take on this employee.

Please help.
