Dear All,
 
This is case, which I came across, where one of the candidate was seeking help -
 
Aparna is working with XYZ Ltd (name withhold) since 2008. Because of some personal issue, she put in her resignation on 27th Nov 2011, which was accepted by the management. Currently she is serving one notice period, which end by 26th  Dec 2011.
 
In the meanwhile on 26th Dec 2011, XYZ’s management agrees to pay the arrears (salary) to all its current employees (who been on their rolls from 1st January 2007 to 31st December 2010)
 
In Aparna case, they completely denied to pay her the arrears.
 
Wanted to know if in such a situation, can she fight for arrears?

Need more details on the case to reach to a conclusion.
 
What are these arrears for? Is the notice specify for a payment for the year 2007 (only) to be paid in 2011 for those who were with the organisation till 2010 end? Details of the notice of arreras shall help.
 
If the notice mentions "Current employees" on the day of declaration and the person has had his/her last day prior to that day, the person is not eligible for the payout - irrespective of the period of arrears being paid for.

Management and the union was fighting for salary increment for almost couple of  year. Now management has agreed to union terms & have agreed to increase the salary & also pay the arrears to all the confirmed staffs who are on the rolls from 1st January 2007 to 31st December 2010.

In  apointment  letter if any clouse those protect her right to incriment other wise In my view managment desission is right
