Dear All,

 
This is to request you all to help me find out some details about the Industrial Employment (Standing Orders) Act, 1946.
 
As we all know the Standing orders are mandatory for any Company to comply with.
 
So, if we consider a situation where the company is small, say there are only 2 employees and the company is not registered and is only 1 year old......so under these circumstances are the Standing Orders mandatory to comply with?
 
Is it mandatory to check the size and age of the company for implementation of any kind of rule?

Please give your views regarding the same and solve my query.

Dear ,

No. In your case this act is not applicable.As per central act it applies only where 100 workmen are employed in industrial establishment.

Many states have amended the applicability clause.In some, it applies to 50, in others appies to 20.

Pl. check about your state. you have not mentioned in which state your establishment is situated.

You need not worry, since the Factories act will not apply to a unit employing only 1-2 persons.

simillarly the IESO act also would not apply.

Dear Vayjanthi,

The standing order is mandatory if the employees strength crosses 100.
 
secondly the model standing orders could be used if the strength is less than 100 and if there is no polcy manual.
