Dear All, 
I have got one query - one of our employee is on leave since last 1 month on medical ground.  He is on probation period. He has also submitted the Medical  Certificate but management want to terminate the person on the base  of Unauthorised Leave.. 
Is it possible? On what ground this can be done?? 
Please Help

In case you want to discharge the services of the concerned probationer you can do so by drawing powers from the relevant clause in the appointment issued to him.

But if you are convinced that the absence was a genuine one then it will be unfair to do so.

If you want to terminate services on the grounds of unauthorised absenteeism you are required to hold an enquiry.

In this case HR Head, has to keep his option open for human values and human respect too, if all these surpasses, he can take decision as management decides.

In the event of casuality approval of leave is not expected everytime & in this case since HR Dept is aware of reason behind leaves, at managements discretion HR could not terminate services.

As it is very easy for an employee to prove the reason. Instead of trapping into legal affairs it is better to check authenticity of the documents submitted by the employee.

Also termination would spread wrong message about mgmt practices due to which chances of loosing loyal employees are more.

As per my opiniion, he must have inform management that he is  not well and will be joining duty after getting well and thereafter he must submit the medical certificate.. if he has not informed the management than management has the right to take action against him.
