Statutory Compliance in IT companies
Hi, This mail is based on a recent visit by labour Inspector to our office (IT Company at Bangalore) to investigate compliance under various legislation (let's say 'N' in no.). Since there is no practice of submitting periodical returns, judgement recorded as 'noncompliant', irrespective of the fact that basic intend of all legislation are taken care in its true spirit(or even higher than what is expected when it comes to welfare, wage/benefits, safety of our employees)
I have following queries on this front... 1) does IT company need to spend time & energy in preparing/maintaining/submitting large no. of reports as defined under acts, as long as we have internal check mechanisms?
2) Are we (IT companies) covered under Labour Welfare Fund Act, wherein it calls for contributions (employee & employer contributions), without any benefit back to the company nor to our employees.
3) How about people working on outsourcing/contract.
4) Is it essential to inform vacant positions to Employment exchange (we know they can't help us in getting a single candidate who match our requirement)
5) Are all fresh recruits from college campus needs be covered under Apprenticeship Act.... list of queries never stops here... probably we can share our practices under this thread for common benefit, which will in turn make us better placed in facing this external 'threat' standing against our time.

The Profession Tax ACT Monthly Returns along with cheque.
The Contract Labour (R&A) ACT, 1970 Half Yearly Return - by Contractor to be submitted to Asst. Labour Commissioner
The Maternity Benefit ACT, 1961 Annual Return
The (National & Festival Holidays) ACT, 1963 Annual Return.
The Minimum Wages ACT, 1948 Annual Return
The Contract Labour (R&A) ACT, 1970 Annual Return by Principal Employer.
The Payment of Wages ACT, 1936 Annual Return
The Employees Provident Fund ACT, 1952 3A & 6A Annual Individual Returns & Returns of Contributions to the Regional Provident Fund Commissioner.
The Employees State Insurance ACT, 1948 Summary of Contribution
The Contract Labour (R&A) ACT, 1970 Renewal of Licence .
The Payment of Bonus ACT, 1965 Annual Return
Shops & Establishment Act Renewal & Registration Certificate.
