Denying Benefits to Telecommuters ?

Denying Benefits to Telecommuters ?

I was wondering whether it is legal for a company to deny benefits to an employee who telecommutes. Here is the situation: My fiance had worked for his employer, based out of NYC, as a full- time employee for 2 1/2 years, receiving full benefits. When he told the company that he was moving out of state, they asked him to stay on, as a telecommuter. He works full time still and has been with the company for a total of 3.5 years now. They no longer provide dental insurance for him, which they do provide for all other full- time employees. Does he have any sort of legal recourse, when asking the company for at least partial reimbursement of his dental expenses? Or is the company in the right, by denying him this benefit which is given to all other full-time employees, since he is now a full-time employee who works from a remote office?
