DEPUTATION

I m working with one NGO and  we are having 3 sister organisation .

As and when require we take the services of employees of our sister organisation ( for short term as well as long term).

I need  help to draft the policy for  inter organisation deputation.

what we do is we sign service agreement in between organizations, having clauses of costing, manpower, nature or work description, duration of the deputation, benefits if any provided by the group concern company for the resource like free lunch or charges, conveyance etc., also no transfer of manpower clause, and poaching related clause so that the congenial factor of the group remains harmonious.

Hi Kishor

To add to what Ms Rani said, you may add one clause in the appointment letter itself that

"Your services will be transferred to our sister companies with the same terms and conditions mentioned in this appointment  letter."

Hi,
As mentioned by Mr. Sampath in the appointment letter only generally a clause for transfer is mentioned, which is as mentioned:

1. Your services can be transferred from one job/position to another, from one department to another or from the appointing company to any other company/division of the ____ Group of companies, or vice-versa, whether existing at present or to be set up in future anywhere in India.

2. In such a case, you will be governed by the rules, regulations and orders as applicable to the establishment to which you have been transferred to, including such conditions and rules covering Working Hours, Leave, Holidays Salary, Allowances and perquisites.

In case of short term transfer/deputation a transfer / redeploment letter is issued to the employee, a term of which is as below:

In accordance with the terms and conditions of your employment, you are hereby transferred from _____to ________ with effect from _____.

By the reason of above transfer:

1. Your services shall not be interrupted on account of this transfer.

2. All agreements or understandings arrived at between, you and _______existing co. shall henceforth, for all purposes, be treated as agreements or understandings arrived at between you and ________new co.

3. You will abide by the rules and regulations as applicable to other employees of ___ new co.

This is done to facilitate clarity to the co as well as the employee. This also facilitates agreement of both involved parties.
