Contract Labour Act

Dear All,

As per Section 4 (b) of The Contract Labour (Regulation  & Abolition) Act, 1970 the provisions of the Act applies to every contractor who employos or who employed preceding  twelve months twenty or more workmen.

Now the question is:

A contractor is engaging only 5 persons under him. Is the  contractor required to maintain registers and other records  required to be maintained under the Act and rules or not.

Yes it is desirable that the contractor maintains it. But does he bound by the statute to maintain it or not.

Please comment.

He is not bound to maintain records as required under the CLRA Act as the Act is not applicable to him unless he has reached the figure of 20 workmen.
