Legal Action against Absconding Employee

Dear All,

I have a situation like, one person joins one organization and works for a day and he doesn't report back to the Organization. He absconds. Can we take any legal
action against him.

I heard from somebody that the employee has to work for a minimum of 15 days in an organization to take legal actions. Is that true...
