Legal Stand : Can not join Competitor for 3 Years

Dear all,

Could anybody please let me know whether the clause  of '' CAN NOT JOIN A  COMPETITOR FOR A PERIOD OF 3 YEARS AFTER LEAVING THE  SERVICES OF THE
COMPANY'' has any legal stand.

Can a person be prosecuted in the Court of Law for  violation of this  clause.

Srini, The legality can not be decided by reading one sentence. You will have to see in which context the same is being written. Please consider the total agreement before any view point is given.

Hi,

As far as I know it will not hold in the court of law as you cannot prevent anyone from making a living. There could be a decleration of non-disclosure at the time of exit. Other than that the company cannot prevent anyone from making a living.
